This online store is operated by SpookiFloats ("we", "us" and "our"). By visiting our store or buying from us, you agree to these Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and Shipping Policy. If you don't agree, please don't use the store.
Our store is hosted on Shopify, which provides the online commerce platform we use to sell our products to you.
1. Using our store
You must be at least the age of majority where you live, or have the consent of a parent or guardian, to place an order. You agree not to use the store for any unlawful purpose, interfere with its security or operation, or upload any harmful code.
2. Products and descriptions
We try to describe and show our products as accurately as possible. Colors, sizes and brightness may look slightly different in person than on your screen. We may limit quantities, discontinue products or decline any order at our discretion.
3. Prices and payment
Prices are in US dollars and may change without notice. If we find a pricing or other error in your order, we'll contact you, and you can choose to continue or cancel for a full refund. You agree to give us current, complete and accurate payment and contact information.
4. Orders and cancellations
We may cancel an order, for example if a product is unavailable, we suspect fraud or there's a pricing error. If we cancel your order, you'll receive a full refund. To cancel your own order, contact us as soon as possible. Once an order has shipped, it can be returned under our Refund Policy.
5. Shipping and returns
Delivery is covered by our Shipping Policy, and returns and refunds by our Refund Policy.
6. Product use and safety
Our inflatables are electrical products. Follow the instructions included with your product, use an outdoor-rated outlet or extension cord when displaying them outside, keep the fan and cords away from standing water, and supervise children and pets around inflated decorations.
7. Reviews and content you send us
If you send us reviews, photos, suggestions or other content, you confirm that it's yours to share and that it's truthful, and you allow us to display and share it on our store and social media channels. We never pay for or write fake reviews.
8. Third-party services and links
Our store uses and may link to third-party services, such as payment processors, shipping carriers and apps. We aren't responsible for their content, policies or services.
9. Intellectual property
The SpookiFloats name, logo, text, graphics and other content in this store belong to us or our licensors. You may not copy or use them without our written permission.
10. Disclaimer
Except as stated in our policies or required by law, the store and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits any rights you have under consumer protection laws that can't be waived.

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special or consequential damages arising from your use of the store or our products, and our total liability for any claim related to an order won't exceed the amount you paid for that order.

You agree to indemnify and hold us harmless from any claims arising from your breach of these Terms or your misuse of the store.

14. Governing law
These Terms are governed by the laws of the State of South Carolina and the United States, without regard to conflict-of-law rules.
